469 Page Censored

Looking at the URL you demanded you wanted to access my archive copy of the old Computer Club Winterthur (CCW) home page, that I made 1997 as the then president of the CCW. Unfortunately I can not any more give you this page. The page has been taken offline.

This was done so because of threat of being sued by the present (January 2001) president of the CCW, because of claimed violation of the local data protection laws [1].

A offer on my part, to clearly mark the page as an historic archive and put an link to the up to date page, so that there is no danger that the page is confused, was bluntly denied.

A lawyer I consulted regards the legal situation as not clear and predicts an long drawn, time wasting, expensive process with unsure result. This page is not worth that to me.

[1] data protection law:

Nominally an law that is intended to protect people from being harmed by anonymuos agents acting on false data.

For this purpose the law forbids any false (and so also outdated) data. Data has to be kept up to date or be deleted.

Historical data archives are though per definition of their purpose (documenting the is/was state when they were recorded) falsified by updating them and so useless.

This law was made in the middle of an "big brother" hysteria, without thinking about the consequences. And because of this without excemption for historic recordings. Even an explicite remark about the nature of the data (archive, not updated) or even an link to updated data is not enough for the law.

So this broken law makes it impossible to publish historic archives, like this old home page, unless one is prepared to go before court and prove an public interest that exceeds data protection interest. That would give an process where an judges judgement, which interest outweighs the other (= unpredictable), decides. An attacked private person can not afford that.

Welcome in the society with legally decreed amnesia.

Consequently today the data protecton law is an popular censorship tool for everyone from small (like the CCW, against this page) to big (Christoph Blocher, swiss politician, against Blocher.org).
